Technically, driving with an open container in a car is prohibited. But what is open? A defense attorney would argue that open container does not apply to a bottle that is closed, or topped, and enclosed in a trunk. Even California allows opened, resealed bottles in the trunk, though. It's also okay if you have an SUV with no trunk, just put it in the far back. If you are in a restaurant and do not drink it all, they will recork it and put it in a bag for you, and should inform you to put it in the trunk or far back.

The Open Container Law. This law states that you cannot have any open containers of alcohol in your vehicle. If you do, it's likely you'll get a container violation. Don’t drive with an open can or bottle in your vehicle (even if you put the cork back in the bottle) – unless it is in the trunk or you are in a bus, taxi or limo. If you do get cited for an open container, contact a skilled defense attorney as soon as possible.
