Staff must know what to look for when checking ID’s to be able to prevent the sale. They must also know how to deal with the customer once a suspected false/counterfeit ID is presented. The legal drinking age in California is 21. You are never required to sell or serve alcohol to anyone. A person does not have a legal “right” to buy alcohol, but you have a legal right to refuse service to anyone who cannot produce adequate evidence of their age.

California alcohol laws can impact people in many ways. Not all of them good. A person age 21 might give alcohol to someone under that age. They might think they are being a good friend. But a conviction can be harmful. It may keep the person from being a law enforcement officer, teacher, lawyer, social worker, etc. Ignorance is no protection.

An expired ID can't be used to purchase alchohol since this would promote an illegal aftermarket for old IDs. So for instance, if an ID expires but could still be used to purchase alcohol, its owner may be tempted to sell it to an underage person who could pass as them.

This is a solid guideline to follow if you live in a state that does not specifically spell out what to do in the case of an expired signer ID. Finally, if you are presented with an unreliable or suspicious ID, the best action you can take is to have your signer provide an alternative form of ID, or use a different method to identify your signer, such as a credible witness or personal knowledge, depending on your state laws.
